1. Acceptance of These Terms

These Terms of Service (“Terms”) govern your access to and use of the Fliyp application, website, and related services (the “Service”), operated by 93 Communications (“Fliyp”, “we”, “us”, “our”). By creating an account, subscribing, or otherwise using the Service, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree, you must not use the Service.

You must be at least 18 years of age and capable of forming a legally binding contract to use the Service. By using the Service, you represent that you meet this requirement.

2. Definitions

• “Content” means the AI-generated horoscopes, life-intelligence readings, scores, and other material the Service generates or displays.
• “Subscription” means a paid plan (Seeker, Destined, or Ascendant) billed on a monthly, quarterly, or annual cycle.
• “You” / “your” means the individual using the Service.
• “Account Settings” means the settings area within the Fliyp app where you manage your profile, subscription, and data.

3. Description of the Service

Fliyp is a personalised daily life-intelligence service. We generate Content based on your Vedic birth chart and numerology profile and deliver it through calendar events, push notifications (mobile app), and email. WhatsApp messages are used for transactional purposes only — one-time passwords (OTP), plan-renewal reminders, GST invoices, opt-in confirmations, and important account-state changes — and not for daily Content delivery.

4. Account Registration and Security

To use the Service you must create an account and provide accurate, current, and complete information.

• You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account.
• You must notify us immediately at [email protected] if you suspect any unauthorised use of your account.
• You may not create an account for another person without their authority, use another person's account, or provide false information. Doing so is grounds for suspension or termination.

5. Subscriptions, Pricing and Billing

Fliyp is a paid subscription service. Prices are charged in Indian Rupees (INR) for users in India and in US Dollars (USD) for international users, determined by your location, and are inclusive of applicable taxes (a GST tax invoice is issued where applicable).

• Monthly plans: Seeker ₹299 · Destined ₹499 · Ascendant ₹899 per month (international: Seeker $8.99 · Destined $12.99 · Ascendant $21.99 per month).
• Quarterly plans: Seeker ₹799 · Destined ₹1,329 · Ascendant ₹2,399 per quarter.
• Annual plans: Seeker ₹2,690 · Destined ₹4,490 · Ascendant ₹8,090 per year.
• Payment processing: Payments are processed by Razorpay. We accept UPI, debit/credit cards, and net banking (international payments are made by card). We do not store your full card details.
• Auto-renewal: Paid plans renew automatically at the end of each billing cycle through a secure payment mandate (UPI AutoPay, card, or net-banking e-mandate) that you authorise with Razorpay. As required by Reserve Bank of India e-mandate rules, Razorpay sends you a pre-debit notification before each renewal charge. You may cancel at any time to stop future renewals (see Section 6).
• Free trial: Where a free trial is offered, it lasts 7 days. Unless you cancel before the trial ends, your Subscription automatically converts to a paid plan and the first charge is taken at the end of the trial. You may cancel during the trial, at no charge, from Account Settings → Subscription.
• Price changes: We may change subscription prices. Any change will apply only from your next renewal, and we will notify you by email at least 14 days before it takes effect, so you can cancel before being charged the new price.

6. Cancellation and Refunds

• Cancellation: You may cancel at any time from Account Settings → Subscription, or by emailing [email protected]. Cancelling stops all future auto-renewal charges. Your access continues until the end of the current paid period; no pro-rata refund is issued for unused days.
• 7-day refund window: You may request a full refund within 7 days of a charge, provided you have not accessed any horoscope or intelligence Content during that period.
• No refund is available after 7 days, or once you have accessed any Content.
• To request a refund, email [email protected] with your order details. Approved refunds are processed within 5–7 business days to your original payment method.
• Nothing in this Section limits any non-excludable refund or cancellation right you may have under applicable consumer-protection law (see Section 13).

7. Acceptable Use

You agree not to:

• Scrape, crawl, or systematically extract Content from the Service by automated means;
• Reverse engineer, decompile, or attempt to derive the source code of the Service;
• Share your account credentials with, or resell access to, any third party;
• Use Content for any commercial purpose without our prior written permission;
• Use the Service to harass, abuse, defame, or harm any person, or to infringe any third-party right;
• Use the Service in any way that violates applicable law or these Terms.

8. AI-Generated Content

Fliyp uses third-party artificial-intelligence providers — primarily OpenAI (GPT-4o), with Anthropic (Claude) as a fallback — to generate personalised Content.

9. Intellectual Property

• Our property: The Service, website, software, user-interface design, brand, logo, and all Content are owned by 93 Communications or its licensors and are protected by applicable intellectual-property laws. We grant you a limited, non-exclusive, non-transferable, revocable licence to use the Service for your personal, non-commercial use.
• Your data: Your personal data remains yours. We process it only as described in our Privacy Policy.

10. Third-Party Services

The Service integrates third-party services (including Razorpay for payments and, if you enable them, Google or Microsoft calendars). Your use of those services is governed by their own terms and privacy policies. We are not responsible for third-party services.

11. Privacy

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference.

12. Disclaimers

To the maximum extent permitted by law, the Service and all Content are provided “as is” and “as available”, without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure.

13. Limitation of Liability

To the maximum extent permitted by applicable law:

• Fliyp (93 Communications) is not liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profit, or goodwill, arising from your use of the Service.
• Our total aggregate liability for any claim shall not exceed the subscription fees you actually paid in the 3 months immediately preceding the event giving rise to the claim.
• Consumer rights are not waived. Nothing in these Terms excludes or limits any liability that cannot be excluded or limited under applicable law, including your statutory rights under the Consumer Protection Act, 2019 (India) or equivalent consumer law, or liability for death or personal injury caused by negligence, or for fraud.

14. Indemnity

You agree to indemnify and hold harmless 93 Communications from any third-party claim arising out of your misuse of the Service, your breach of these Terms, or your violation of any law or third-party right. This Section does not apply to the extent a claim arises from our own breach or negligence.

15. Termination

• By you: You may stop using the Service at any time and delete your account via Account Settings → Your Data → Delete my account (a 30-day grace period applies before permanent deletion).
• By us: We may suspend or terminate your account immediately if you materially breach these Terms or use the Service unlawfully.
• Service discontinuation: We may discontinue the Service entirely on 30 days' notice, in which case we will issue a pro-rata refund for the unused portion of any paid Subscription.
• Sections that by their nature should survive termination (including Sections 9, 12, 13, 14, 18, and 19) survive.

16. Changes to These Terms

We may update these Terms from time to time. For material changes, we will notify you by email at least 14 days before the change takes effect and display a notice in the app, and — where required by law — obtain your renewed consent. Continued use after a change takes effect constitutes acceptance.

17. Force Majeure

We are not liable for any failure or delay in performance caused by events beyond our reasonable control, including acts of God, natural disasters, war, civil unrest, strikes, failures of payment networks, internet or hosting providers, or government action.

18. General

• Severability: If any provision of these Terms is found unenforceable, the remaining provisions remain in full force.
• No waiver: Our failure to enforce any provision is not a waiver of our right to do so later.
• Entire agreement: These Terms and the Privacy Policy are the entire agreement between you and us regarding the Service.
• Assignment: You may not assign these Terms. We may assign them to an affiliate or successor on notice.
• No third-party beneficiaries: These Terms do not create rights for any person who is not a party to them.

19. Governing Law and Dispute Resolution

These Terms are governed by the laws of India. Subject to your non-excludable right to approach the consumer forums established under the Consumer Protection Act, 2019, the courts at Noida, Uttar Pradesh, India have exclusive jurisdiction over any dispute arising from these Terms.
